We closed the vacancy loophole—but those protections officially expire on June 6!
Under California's SB 1123, developers can utilize a ministerial approval process to bypass local zoning requirements. If an application meets basic state criteria, the City of Campbell is legally mandated to approve up to 9 units on a single-family lot within 60 days—completely eliminating public hearings, neighborhood notices, environmental studies, or discretionary council review. Currently, 16 projects are tracked in the pipeline across Campbell.
On April 21, intense community advocacy influenced the Campbell City Council to pass Ordinance No. 26-2347, closing the loophole that previously allowed occupied homes to be slated for demolition. This protection dictates that “Starter Home” applications can only be submitted for lots that are already truly vacant (or if the structure is abandoned or uninhabitable).
However, this safeguard is temporary. The ordinance will officially expire on June 6. On June 7, the legal loophole is scheduled to reopen completely, allowing developers to resume targeting occupied neighborhood homes unless we secure an extension.
